These Terms of Use (“Terms”) govern your access to and use of the InstaVPN mobile application (“App”), provided by InstaVPN (“Service Provider,” “we,” “us,” or “our”). The App is offered as a Freemium service (“Service”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not install or use the App.


1. License and Scope

1.1 License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, strictly in accordance with these Terms. All rights not expressly granted herein are reserved by the Service Provider.

1.2 Modifications and Updates
We reserve the right to modify, update, or discontinue the App or any features thereof at any time without prior notice. You acknowledge that it is your responsibility to monitor for updates and install them. Continued use of the App following any changes constitutes acceptance of those changes.


2. Acceptable Use

2.1 Compliance with Laws
You agree to use the App in compliance with all applicable local, national, and international laws and regulations, including, but not limited to, laws related to intellectual property, cybersecurity, privacy, and data protection.

2.2 Prohibited Activities
You must not use the App in any manner that:

  • Violates or infringes upon the rights of any third parties, including intellectual property rights.
  • Involves unauthorized access to, or use of, any servers, networks, or systems.
  • Facilitates or participates in Distributed Denial-of-Service (DDoS) attacks, hacking, or other malicious activities.
  • Transmits viruses, malware, or other harmful code.
  • Harasses, defames, or otherwise harms any individual or entity.
  • Circumvents or attempts to circumvent security measures implemented by us or our service providers.

2.3 Fair Use Policy
You may not use the App in a way that imposes an unreasonable or disproportionately large load on our infrastructure or otherwise degrades or disrupts our services.


3. Intellectual Property

3.1 Ownership
All trademarks, copyrights, database rights, and other intellectual property rights in and to the App are owned by or licensed to the Service Provider. You are granted no ownership rights in the App or associated materials.

3.2 Restrictions
You must not copy, reproduce, distribute, modify, create derivative works from, reverse engineer, decompile, or otherwise attempt to extract the source code of the App without our prior written consent.


4. Subscriptions and In-App Purchases

4.1 Freemium Model
The App is provided under a Freemium model. Certain basic functionalities may be accessed free of charge, while Premium features require a valid subscription.

4.2 Third-Party Platforms
Subscriptions and in-app purchases are processed through external platforms (e.g., AppHud and official application marketplaces like the Apple App Store). We do not store or process payment card details. Please review the relevant terms and conditions of these platforms for additional information.

4.3 Billing and Renewals
If you choose to purchase a subscription, fees may be charged on a recurring basis. Your subscription will automatically renew unless canceled at least 24 hours before the end of the current billing cycle. You are responsible for managing your subscription in your device’s account settings.


5. Third-Party Services

5.1 External Providers
We integrate third-party services for analytics, crash reporting, remote configuration, messaging, and other functionalities, including but not limited to:

  • Google Analytics for Firebase and Firebase Crashlytics
  • Amplitude
  • AppHud

5.2 Independent Terms
Each third-party service may have its own terms, conditions, and privacy policies. We encourage you to review these as we are not responsible for practices of external providers.


6. Disclaimers and Limitations of Liability

6.1 No Warranties
The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not warrant that the App will be error-free, uninterrupted, or meet your specific needs.

6.2 Connectivity and Data Charges
You are responsible for maintaining an internet connection (Wi-Fi or mobile data). We assume no liability if the App fails to operate due to lack of internet access. Any data charges incurred (including roaming fees) are your responsibility.

6.3 Battery and Device Maintenance
You are responsible for ensuring your device is adequately powered and maintained. We will not be liable if you cannot use the App due to device-related issues.

6.4 Limitation of Liability
To the maximum extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of data, revenue, or profits arising from or related to the use or inability to use the App.


7. Indemnification

You agree to indemnify and hold harmless the Service Provider, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in connection with your violation of these Terms or applicable laws.


8. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without prior notice, for conduct that we believe violates these Terms or is otherwise harmful. Upon termination, you must cease using the App and delete it from your devices.


9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the Service Provider is registered. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.


10. Changes to These Terms

We may update or modify these Terms at any time. Changes will be posted within the App or on our official website (if applicable), and the “Last Updated” date will be revised accordingly. By continuing to use the App after any changes, you agree to the updated Terms.
